1. Username and Password
When logging in for the first time and if you agree with the Disclaimer, you must replace the password provided with a personal password chosen by you and under your sole responsibility.
The personal password will be confidential and non-transferable, whereby the USER assumes the consequences of its disclosure to any third party, releasing LATAM CONSULTUS from any liability that may arise from such disclosure.
The USER hereby directs LATAM CONSULTUS to accept and understand that any login made by any person providing the Username and the personal Password shall be deemed to have been made by the USER. In such case, and once these requirements have been met, LATAM CONSULTUS shall consider that all login actions have been carried out by the USER without the need to make, carry out or undertake any other safeguard provisions of any kind.
Consequently, the USER expressly waives any claim and/or defense based on lack of proof of existence of the request or the use of the password, assuming any legal consequence arising from the use of the system on the USER’s behalf to be essential to the agreement.
Likewise, all printing and/or disclosure of information accessed by the USER using this service shall be YOUR sole responsibility.
2. Use of information, recommendations, analysis and ideas provided by LATAM CONSULTUS:
The USER acknowledges and agrees that:
i. The information, recommendations, analysis, conclusions and ideas provided by LATAM CONSULTUS are merely opinions of LATAM CONSULTUS and, consequently, should in no way be construed as investment advice or suggested sales, purchases, investments or transactions of any nature whatsoever.
ii. The use of all the information, recommendations, analysis and ideas provided by LATAM CONSULTUS are the USER’s sole responsibility, and that LATAM CONSULTUS shall not be liable in any way for any results or any economic and/or financial and/or in-kind performance and/or any investment or transaction amounts made by the USER’s clients carried out using the information, recommendations, analysis, conclusions and ideas provided by LATAM CONSULTUS pursuant to this agreement.
iii. Product valuations may go up as well as down as a result of market fluctuations.
iv. Current or past performance is not necessarily indicative of future returns.
v. LATAM CONSULTUS does not guarantee that the information contained in this website is accurate, complete or timely, since such information is only accurate as of the date of publication; and that product prices are merely indicative and should not be relied upon for the purpose of advising clients.
vi. It undertakes all risks and exonerates LATAM CONSULTUS from any liability.
3. Platform:
The USER acknowledges and accepts that the platform may, without prior notice, be temporarily unavailable or restricted for administrative or other reasons, not implying LATAM CONSULTUS has breached the agreement in any way.
